Sorry to drag up an older thread, especially since I just registered, but I felt I had to make some things clear as an actual member of the Abandonware Community.

First of all, all forms of software piracy are Illegal. Abandonware is a form of software piracy as much as warez is. The only difference is a moral one.

In the Abandonware Community we seek to preserve old game titles which are no longer produced and supported by their respective copyright holders and such. One very common mis-conception about Abandonware is that it's about free games. It isn't. In fact, for anyone serious about Abandonware and what it stands for, to see games put back into production and available for sale would be a great step forward, as too often great games dissapear never to be heard of again.

So yeah, there is no such thing as an Abandonware legality issue, it's 100% illegal, as copyrights generally dont' expire for 75 years.

And on another note, this is one huge forum you have here. O_o
