Post Dead Character?

I heard a rumor from a guy who said you could actually lose a character in HC permanently, so I took my lvl 34 Necro and got him killed in HC just to test it, and now I can't play him at all! I hope Blizzard will fix this bug! I've spent over 8 hours on him, and I want him back! I read the ToS three times, and it said nothing about losing a char permanently, so bring him back, or I'll sue!
